This Agreement is a legal agreement between Users (“You” and “Your” and “Users” and “Customer”) and Registrants of Gateway Real Estate Media, whether visiting or registering, purchasing products and services, or making any other use of this site.

By using the Gateway Real Estate Media Website (www.ReflectingWalls.com), You agree to be bound by these Terms of Service (this “Agreement”), whether or not You register on the Site. If You wish to register and make use of the Gateway Real Estate Media services (the “Services”), please read these Terms of Service. If You object to anything in this Agreement, do not use the Site or the Service. The Terms of Service are subject to change by Gateway Real Estate Media at any time, effective upon postings on the Gateway Real Estate Media Site, and Your use of the Service after such posting will constitute acceptance by You of any changes.

By placing an order with us, whether completed on the Gateway Real Estate Media Website (www.gatewayremedia.com), placed over the phone or placed over email, You agree that You have read, understood, and agreed to be bound by this Agreement and will comply with all of the terms and conditions of this Agreement. If You do not agree to be bound by this Agreement, You are not permitted to access or use any part of the Site or its Services.

Inclement Weather / Rainy Day Policy

In the event of Inclement weather, our photographers will keep all appointments on calendar as scheduled, unless cancelled or rescheduled by client. Responsibility to reschedule appointment due to weather lies solely on the client. We do offer free same day cancellation for bad weather conditions. Must be cancelled 2 hours or more prior to appointment. If there is rain during the photoshoot, we will still be taking all exterior images as normal. If you prefer not to have any possible rain in photos, we have the following solutions for you:

1. Re-visit the property at a later date & time for a discounted fee of $50to capture only exteriors. Must contact the office to schedule this, the photographers have no control over scheduling.
2. Realtor or homeowner may take the images of exterior at a later date with no rain, and email to us for free editing.

Order Adjustment:

If the customer orders a certain amount of photos, yet requests more photos be done during the appointment, the customer will be billed for the additional service rendered.

Order Cancellation:

We offer free order cancellation with at least 24 hours notice. If the order is cancelled with less than 24 hours notice of the photo shoot, we have a $50 cancellation fee. If the photographer arrives at the property and the job is cancelled at that point for any reason, and that property was out of our typical service area, there is a travel fee charged in addition to the $50 cancellation fee.

Order Rescheduling:

We offer free order rescheduling with at least 24 hours notice. If the order is rescheduled on the day of the photo shoot, we have a $50 cancellation fee for that order, and we will reschedule the order for the new appointment date. If the photographer arrives at the property and the job is cancelled/postponed at that point for any reason, and that property was out of our typical service area, there is a travel fee charged in addition to the $50 cancellation/reschedule fee.

Ownership:

All photos provided to You through the Services of this Site (www.GatewayREmedia.com) are solely and exclusively owned by Gateway Real Estate Media. As such, Gateway Real Estate Media reserves all rights of ownership including but not limited to the distribution, publication, alteration, sale, resale and duplication of any and all photos provided to You through the Services and this Site for whatever reason in Gateway Real Estate Media sole and absolute discretion. As a User of the Site and Services, upon purchasing and paying in full for the Services received, you are granted a limited, terminable, non-exclusive license to use the photos and other Services provided to You by Gateway Real Estate Media in any legal manner You should choose. You are not, however, granted a license to sell, transfer, license, and sub-license or otherwise distribute the Services, any component of the Service, or any products or services derived or developed from or based on the Service to any third party. Users may transfer the Deliverables associated with the Service to their MLS provider for the sole purpose of fulfilling the defined purposes of the MLS provider. Such transfer of this limited usage license to the MLS shall not in any way be construed as a transfer of ownership to the MLS.

Photo Ready:

Customer agrees to have listing clean, neat and photo ready prior to photographer arriving at appointment location.

Prepared Occupant:

The person placing the order is responsible for making sure that the occupant of the home is well aware of the appointment day and time, and understands that we need the home to be photo ready prior to our arrival. We do not schedule the photo appointment with your occupant for you. That must be agreed between you and your home occupant to get the best appointment time prior to placing the order online. We can schedule the appointment with your occupant directly if requested by you, prior to the order being placed.
